These terms of use constitute an agreement (the "Agreement") between you ("You") and LecToGo AB, company reg. no. 559156-1484 ("LecToGo"), and set out the legally binding terms governing your use of the services (the "Services") provided by LecToGo. The purpose of this Agreement is to govern the power bank rental services that LecToGo provides to you.

To use the Services you must accept all terms of this Agreement. "Services" means charging stations, power banks, the LecToGo app and its related services as described in the app, together with any other related information made available by LecToGo.

The "LecToGo app" means the software applications available via mobile devices and web browsers through which you access the charging stations and power banks.

1. General

1.1 Parties to the Agreement

You and LecToGo are the only parties to this Agreement. You are the sole user of the Services and are therefore solely responsible for compliance with all terms set out in the Agreement.

1.2 You acknowledge and agree that

  • You are at least 18 years old.

  • You know how to operate a power bank safely and correctly.

  • You will use the charging stations and power banks with care and will not damage them. You are liable for any damage caused to charging stations or power banks by your own or a third party's improper use.

  • The Services and all equipment remain at all times the property of LecToGo. A rented power bank never becomes your property.

  • The number of charging stations and power banks is limited and availability cannot be guaranteed. Access may be limited by maintenance, force majeure or other circumstances beyond LecToGo's control.

1.3 How to use the Services

Via the mobile app:

  1. Download the LecToGo app from the App Store or Google Play.

  2. Sign in with your phone number or via Facebook or Google.

  3. A map will show your position and nearby LecToGo stations.

  4. At the station, open the QR scanner in the app and scan the QR code on the charging station to start the rental.

Via the web app (without downloading the app):

  1. Scan the QR code on the charging station with your phone camera.

  2. The web app opens automatically in your browser.

  3. Select a payment method and follow the instructions to start the rental.

1.4 Unauthorised use

You may not attempt to gain unauthorised access to the LecToGo app, charging stations or power banks. The app, charging stations and power banks may only be used for the purposes set out in this Agreement.

1.5 Rental period and return

The maximum rental period for a power bank is 72 hours from the start of the rental.

The power bank must be returned to a LecToGo charging station with an available slot. The rental ends only when the power bank has been registered as returned at a station.

If the power bank has not been returned within the maximum rental period, it is considered lost. LecToGo will then charge a replacement fee according to the price list applicable in the market where the rental started. The fee corresponds to LecToGo's cost of replacing the equipment and is shown in the app before the rental starts.

The replacement fee replaces the ongoing rental fee. You will therefore not be charged both a full rental fee and a replacement fee for the same rental.

If you return the power bank after the replacement fee has been charged, no refund is made, but you will not be charged any further fee.

1.6 Fees and payment

The rental is charged according to the pricing shown in the LecToGo app at the start of the rental. Fees may be subject to applicable VAT and other public charges.

LecToGo will charge your registered payment card or other agreed payment method:

  • when the power bank is returned to a station, or

  • when the maximum rental period has been exceeded in accordance with clause 1.5.

Prepaid balance is non-refundable.

1.7 Payment methods and authorisation to charge

To use the Services you must register a valid debit or credit card with LecToGo's payment provider. You confirm that you are authorised to use the card you register.

You authorise LecToGo to charge the registered card for all fees you incur under this Agreement, including fees arising after the rental has ended. This authorisation applies even when you are not present at the time of payment.

If a charge fails, LecToGo is entitled to make repeated attempts to charge the card or cards you have registered, for up to twelve (12) months from the date the fee arose. LecToGo is entitled to charge partial amounts where the full amount cannot be collected.

If you wish to dispute a charge, you must contact LecToGo in accordance with clause 7 within two (2) months of the date the charge was made.

1.8 Unpaid fees

If a fee cannot be charged to your card, the payment obligation remains.

LecToGo is entitled to demand payment by other means, including by invoice sent to the email address or postal address you have provided or which is otherwise known to LecToGo.

In the event of non-payment, LecToGo is entitled to charge:

  • a reminder fee as permitted by law,

  • late payment interest in accordance with applicable law from the due date, and

  • compensation for debt collection costs as permitted by law.

LecToGo is entitled to assign the claim to a debt collection agency or other third party for recovery. In such cases LecToGo is entitled to disclose the personal data required for the recovery, in accordance with clause 3.

LecToGo is entitled to suspend your access to the Services until overdue fees have been settled.

1.9 VAT

All transactions are subject to VAT in accordance with the legislation applicable in the market where the rental takes place. The applicable VAT rate is stated on the receipt and in the price information in the app.

2. Limitation of liability

You use the Services and handle charging stations and power banks at your own risk. LecToGo gives no warranties in respect of the Services beyond those required by mandatory law.

The transmission of information over telecommunications networks is unpredictable and depends, among other things, on your telecom operator and on your device functioning correctly. LecToGo does not guarantee uninterrupted access to the Services.

Nothing in this clause limits your statutory rights as a consumer.

3. Personal data

By using the Services you agree that LecToGo processes your personal data in accordance with LecToGo's privacy policy, available at www.lectogo.com/privacypolicy

In order to recover unpaid fees under clause 1.8, LecToGo may need to process and disclose information about you to payment providers, debt collection agencies and public authorities. The legal basis for this processing is LecToGo's legitimate interest in recovering overdue claims and the performance of this Agreement.

4. Term, termination and cancellation

4.1 Commencement

The Agreement takes effect between you and LecToGo from the first time you use the Services.

4.2 Ending the Agreement

You may uninstall the LecToGo app at any time. The Agreement applies for as long as you use the Services and expires ten years after your most recent use.

Payment obligations for fees incurred before the Agreement ends remain in force.

4.3 Termination by LecToGo

LecToGo may at any time terminate your right to use the Services. The Agreement continues to apply according to its terms after such termination, to the extent required to settle fees and obligations arising before that date.

5. Disputes

Disputes concerning the Agreement should first be raised in writing to the contact details in clause 7.

As a consumer you also have the right to refer the matter to the Swedish National Board for Consumer Disputes (ARN), Box 174, 101 23 Stockholm, Sweden, www.arn.se, or to the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr

6. Changes to the terms

LecToGo may amend the Agreement. Material changes will be notified in the app or via the contact details you have provided at least thirty (30) days before they take effect.

Changes apply to rentals started after the change takes effect. Fees arising before that date are governed by the terms in force at the time of the rental.

By continuing to use the Services after a change has taken effect, you accept the amended terms.

The prices shown in the LecToGo app take precedence over any price information in the Agreement.

8. Governing law and jurisdiction

The Agreement is governed by Swedish law.

Disputes shall be settled by Swedish courts with Västmanland District Court (Västmanlands tingsrätt) as the court of first instance. As a consumer you always have the right to bring proceedings before the court in your place of residence.

9. Entire agreement

The Agreement constitutes the entire agreement between you and LecToGo and supersedes all prior agreements, whether written or oral.
